Pivot Park Privacy Statement 

Introduction  

Pivot Park Exploitatie B.V. is a Dutch company that exploits real estate and provides services to tenants. When you use our website www.pivotpark.com, it is possible that your personal data as referred to in the General Data Protection Regulation (‘GDPR’) will be processed. As processor, we are responsible for handling all personal data with care, so we comply with all requirements imposed by privacy legislation. This means that we only process your personal data when it is necessary and lawful. It is no obligation to share personal data with us, but without providing us the data as stated in this privacy statement, you may not be able to use the website properly. 

As required by the GDPR, we inform you about the handling of your personal data in the form of this Privacy and Cookie Statement. In this statement we summarize when and how your personal data is collected, used, secured and disclosed by us.  

 

General 

Pivot Park may change the provisions of this statement if needed. If these changes are impactful, we will inform you by email (if your email address is known to us). Nevertheless, we advise you to check on a regular basis whether this statement has been changed. The last change was in April 2024.  

 

Which personal data do we collect, on what grounds and how long do we retain this data?  

When you browse our website, we process the following personal data from you: 

  • login data 
  • IP address 
  • MAC address 
  • location  
  • operating system (such as iOS or Android) 
  • identifiers in cookies 

We collect this data based on our legitimate interest. We use this data to improve our website. This personal data is directly collected by us. We retain this data for 26 months. 

When you fill out the contact information form or the form to schedule an online meeting to learn more about Pivot Park under the ‘Join us’ tab, we also process the following personal data: 

  • first and last name 
  • company name 
  • address 
  • email address 
  • telephone number  

We collect this data because it is necessary for the performance of a contract. Without this information, we cannot contact you. This personal data is provided to us directly provided by you. If you fill in any optional information, you do so based on your consent. We retain this data for as long as we need the data to handle your request or until you request us to delete your data (whichever option is earlier). 

If you wish to receive our newsletter, we process the following personal data: 

  • first and last name 
  • company name 
  • email address 
  • telephone number 

We collect this data based on your consent. Without the mandatory information we cannot send you our newsletter. Providing any additional information is optional. This personal data is provided to us directly by you. We retain this data for until you revoke your consent by unsubscribing from the newsletter. You can do this at any time using the link in the newsletter.  


Storage and transferring of personal data
 

Most of our data is stored on servers in the European Economic Area (EEA). We transfer the data you provided to third parties if this is necessary for the provision of the requested services, if you have given your prior consent or if we are legally obliged to do so. As third parties, we use Google Analytics and a newsletter provider, which are based in the United States of America. These companies use the EU’s Standard Contractual Clauses (“SCCs”). This means that we can transfer your data under article 46 GDPR without having to take additional measures, since these safeguards are pre-approved by the European Commission and offer similar protection when transferring data outside of the EEA.   

 

Protection of personal data 

Pivot Park takes appropriate technical and organizational security measures for the protection of your personal data. We follow generally accepted standards for this protection. We would like to point out that absolute security for transmitting personal data over the internet, or for storing personal data, cannot be guaranteed. We have taken the following measures: 

  • SSL (Secure Socket Layer) technology to encrypt the transmission of sensitive information or personal data, such as account passwords and other identifiable information regarding payments. 
  • Back-ups of personal data are made if reasonably possible. 
  • Firewall.  

 

Links to third party websites 

The website may contain hyperlinks to third-party websites. These hyperlinks are there for your convenience,but can process information about you. We have no control over these websites or their activities. If you provide personal data on third-party pages, Pivot Park is not involved. In that case, the privacy statement of this third party applies. We advise you to study their privacy and security practices and their statement before you provide personal data to them.

Our website uses cookies. For more information, we refer you to our Cookie Statement (www.pivotpark.com/cookie-statement-eu). 

 

Your rights 

You have the right to access, correct, transfer and/or delete the personal data collected by the website. In some cases you can also request us to temporarily restrict the processing of your personal data or object to the processing of your data in the future. These rights are not absolute, sometimes we have the right to store your personal data. For example for dispute resolution, enforcement of applicable terms of use, technical and/or legal requirements. 

Pivot Park does not use automated decision making.  

If you would like to exercise any of your rights, please contact us using the contact details as stated below. Please note that the consequence of removal of personal data, restriction of the processing or withdrawal of permission may be that you can no longer (properly) use the website. 

In order to access your own personal data by e-mail, we may ask you to provide sufficient evidence of your identity. If we are not sure whether you are the actual person to whom the personal data relates, we can deny you access to the personal data. 

We will respond to all your requests within 4 weeks. For complex requests, this period can be extended by 4 weeks. If we do extend this period, we will notify you within 4 weeks after you submitted your request.

You also have the right to submit a complaint to the authorized privacy authority regarding about the way we handle your personal data. In the Netherlands this is the Dutch Data Protection Authority (Autoriteit Persoonsgegevens), which you can reach at https://autoriteitpersoonsgegevens.nl.
